GENERAL CONDITIONS

The following terms and conditions (hereinafter referred to as "Terms and Conditions") apply to all orders placed by the customer (hereinafter referred to as "you") on the Citron Jaune website (hereinafter referred to as "the Website").

By placing an order on the Website, you agree to be bound by the rules and conditions outlined below. Please ensure that you carefully read and understand these Terms and Conditions before placing your order.

The presentation of products on the Website at any given time does not guarantee their availability indefinitely. We reserve the right to discontinue the sale of any product at any time. Additionally, we reserve the right to modify these Terms and Conditions periodically without notice. The applicable version of the Terms and Conditions is the one posted on the Website at the time of your order.

PRICE, PAYMENT, AND DELIVERY

The prices displayed on the website does not include VAT and  delivery costs, which will be added to the total amount payable (please refer to the "Delivery" section).

Upon selecting all desired items for purchase, they will be added to your shopping cart. We will then process your order upon acceptance of your shopping cart and prompt you to proceed with payment. You must follow all the steps of the shopping process and complete or verify all requested information. Until you have completed payment, you may modify your order.

Upon acceptance of your payment, you will receive a confirmation email of your order. Citron Jaune agrees to fulfill orders received only within the limits of available stock. If a product becomes unavailable, Citron Jaune will inform you as soon as possible and provide an estimated availability date. You will then have the option to wait for the item to become available or cancel your order. In the latter case, the unavailable item will be refunded using the same payment method you used for your order (please refer to the "Exchange and Refund" section).

In accordance with prevailing rules and regulations, all purchases made through the Website are subject to Value Added Tax (VAT). The place of supply shall be deemed to be within Canada, and applicable VAT shall be at the prevailing rate in accordance with Canadian regulations.

PAYMENT MADE OUTSIDE CANADA

For payments made outside of Canada, customers are responsible for any applicable taxes, customs duties, and transportation fees imposed by their country. Citron Jaune is not responsible for any additional fees applied by the country where the order is shipped. It is the customer's responsibility to inquire about and comply with their country's import regulations and associated costs.

Please note that we are not obligated to sell a product at an incorrectly lower price (even after sending a delivery confirmation) if the mistake is obvious and unambiguous and if you could reasonably identify it as a mistake.

Accepted means of payment include Visa, Mastercard, American Express, PayPal, or gift cards. Your credit card details will be encrypted to minimize the possibility of unauthorized access. By accepting the payment, you confirm that you are the owner of the credit card or the legitimate holder of the PayPal account or gift card.

If the payment pre-authorization is denied by your bank, we will not be liable for any delay or non-delivery.

LEGAL WARRANTIES

As a consumer in Canada, you are entitled to certain legal warranties when purchasing items from the Citron Jaune website. These warranties include the legal warranty of conformity and a warranty against hidden defects. Citron Jaune is responsible for ensuring that the products sold on the website comply with these statutory warranties.

Warranty against hidden defects:

In accordance with Section 218 of the Canadian Consumer Protection Act:

"The seller is obligated to provide a warranty against hidden defects of the thing sold that render it unfit for the purpose for which it was intended, or that decrease its usefulness to such an extent that the buyer would not have bought it, or would have paid a lower price for it, if they had been aware of the defects."

Section 218, paragraph 1 of the Canadian Consumer Protection Act:

"Any action resulting from hidden defects must be brought by the purchaser within two years from the date on which the defect is discovered."

Warranty of conformity:

In accordance with Section 52 of the Canadian Consumer Protection Act:

"The seller must deliver goods that are in conformity with the contract of sale and is responsible for any lack of conformity existing at the time of delivery. It is also responsible for any lack of conformity resulting from packaging, assembly instructions, or installation instructions, if it assumed responsibility for these or had them carried out under its responsibility."

Section 53 of the Canadian Consumer Protection Act:

"In order to be in conformity with the contract of sale, the goods must:

  1. Be fit for the purpose for which goods of the same type are ordinarily used and must, if applicable, correspond to the description given by the seller and possess the qualities that the seller has held out to the purchaser as a sample or model;

  2. Be fit for any particular purpose for which the purchaser has made known to the seller at the time of entering into the contract, and the seller has accepted."

Section 55 of the Canadian Consumer Protection Act:

"Any lack of conformity that becomes apparent within six months after the goods are delivered to the purchaser is presumed to have existed at the time of delivery, unless the presumption is inconsistent with the nature of the goods or the nature of the lack of conformity."

Section 58 of the Canadian Consumer Protection Act:

"Any action resulting from a lack of conformity must be brought by the purchaser within two years after the goods are delivered."

The collection and processing of information and data are necessary for order registration and tracking, account management, and ensuring the quality of our relationships.
